AI & the Attorney-Client Privilege: A Dawn of a New Era?
In recent months, as courts wrestle with the new realities of use (and misuse) of AI in legal proceedings, a new claim began to emerge: The information gathered by AI search is protected under the Attorney-Client Privilege (ACP) or the Attorney-Work Product doctrine. Several courts arrived at different results, and the future is far from clear. Several experts with diverse backgrounds in legal ethics, technology, and their intersection will discuss the new developments and their implications for future use.

Professor Doron Kalir joined the Cleveland State University College of Law faculty in 2012 and serves as a Clinical Professor, directing the Appellate Clinic and teaching courses in legal ethics, federal courts, and contracts. Through the clinic, he and his students have represented individuals and organizations before state, federal, and immigration courts, including the United States Supreme Court. His scholarship focuses on Supreme Court practice, statutory interpretation, federal courts, LGBTQ rights, and Jewish law, and his work has appeared in numerous law reviews and national media outlets. Born and raised in Israel, Professor Kalir completed military service before earning his LL.B. and LL.M. from the Hebrew University of Jerusalem, later arguing cases before the Israeli Supreme Court. He subsequently studied and taught at Columbia Law School and practiced law in New York, primarily with Skadden, Arps, before moving to Cleveland.

Co-Interim Dean Brian Ray started his teaching career at Cleveland State University College of Law in 2006 and most recently served as the Associate Dean for Faculty Development and Online Programs. He helped to launch the Law College’s online J.D. program, which has nearly tripled first-year enrollment in the part-time program. His research focuses on cybersecurity, data privacy, and AI law and policy. He has been the principal investigator and part of interdisciplinary research teams that have received over $4.5 million for projects related to cybersecurity and data privacy education, surveillance technologies, and pandemic preparation and response. He co-founded and directs the Center for Cybersecurity and Privacy Protection and created and directs the online Master of Legal Studies in Cybersecurity & Data Privacy. He serves on the CyberOhio Advisory Board, which drafted Ohio’s first-in-the-nation incentive-based cybersecurity law and served on the Ohio Attorney General Facial Recognition Task Force. He also is expert in comparative constitutional law and spent 2013 as a Fulbright Scholar in South Africa conducting research for his book Engaging with Social Rights (Cambridge Univ. Press 2016).

Harlan Sands is a nationally recognized higher education leader, attorney, educator, and former university president with more than 25 years of experience in higher education administration, finance, student success, and organizational transformation. He served as President of Cleveland State University from 2018 to 2022 and now teaches Professional Responsibility and Legal Ethics at Cleveland State University College of Law. His previous leadership roles include senior administrative positions at the Wharton School of the University of Pennsylvania, the University of Louisville, and the University of Alabama at Birmingham. Earlier in his career, he taught criminal justice and law related courses at Florida International University and practiced as an Assistant Public Defender in Miami. Sands holds degrees from the University of Pennsylvania, George Washington University, and George Mason University, and served a decade on active duty in the U.S. Navy as a Surface Warfare Officer and Naval Intelligence Officer.
Cory Scott

Cory Scott brings more than 25 years of cybersecurity expertise across private industry and public service, including vulnerability research, forensics, and incident response, along with security leadership roles at major financial institutions and technology companies including LinkedIn, Microsoft, Google, and Confluent. He currently serves as Deputy Regional Lead for the Cleveland branch of the Ohio Cyber Reserve, part of the Ohio Military Reserve focused on protecting state governmental bodies against cyberattacks. His research focuses on cybersecurity for public sector organizations and critical infrastructure, data protection for large multitenant service providers, and the intersection of cybersecurity with legal practice and professional ethics. He has presented at Black Hat Briefings, USENIX, OWASP, RSA Conference, and SANS.
